Job Summary
• To assist Absa in identifying, eliminating, minimising and managing legal risk, anticipating issues and estimating risks strategically by liaising directly with the business or legal advisers of the businesses as appropriate and providing effective legal guidance to facilitate business strategy development
• To provide efficient and effective legal risk management support to the Head of Legal Zambia in the form of monitoring and compliance with internal policies and manage the impact of external factors affecting the business;
Job Description
Support the Head of Legal Zambia in:
Supporting the business in long-term growth by providing pragmatic and effective legal advice to manage legal risk across the business and assist in the design and implementation of procedures to manage legal risk at an appropriate level.
Ensuring that all aspects of legal risk are identified covered and controlled in the implementation of new projects, systems, procedures and products
Providing focused support to Corporate, , Business Banking, Treasury and Corporate Credit in turning around and closing corporate, business banking and RMP/ markets transactions to support the Bank’s strategy to grow wallet share in the targeted areas.
Liaising and engaging ARO stakeholders to obtain support and approval for syndicated transactions as well as transactions booked off-shore.
Providing support to other SBUs in the Absa ARO on corporate, business banking and Treasury transactions.
Negotiating terms and conditions for high level credits, facilities and contracts that ensure appropriate protection of the Bank’s interests.
Ensuring all aspects of legal risk are identified eliminated or mitigate and managed in all business areas of the Bank including corporate, credit, retail, treasury, operations, HR and compliance by reviewing, negotiating and drafting agreements/documents in accordance with the requirements of the Contractual Arrangements Policy.
Developing and delivering strategic legal risk management initiatives and assisting the business in crisis management situations.
Ensuring best practices are adopted and guidelines complied with, and that all activities comply with applicable laws, rules and regulations.
Ensuring that changes and developments in legislation, regulations, guidelines and practices affecting the markets in which Zambia operates are analyzed, evaluated and reported as required. Formulate strategies that ensure Bank’s compliance with changes.
Attend to identification, evaluation and appointment as well as manage relationship with Legal Panel Firms and undertake annual reviews of the firms.
Providing legal opinions and advice on all activities of the business.
Providing effective collaboration with other teams (legal and non-legal) within business and across jurisdictions on various issues including Absa ARO transaction
Managing litigation within litigation policy framework by attending to the investigation and collection of evidence and other requirements for pre-litigation work to ensure risks are minimized and legal rights of the Bank are maximized.
Negotiating settlements for litigation cases to protect the Bank’s interests.
Prepare and escalate reports to management and Group as necessary.
Ensure full and effective compliance with legal Risk policies and framework and advise the business on any new legislative or judicial changes which affect the business and how they can be complied with..
Contribute to developing and improving effective and robust control environment of the team and business taking account of current risks and trends in local and international financial environment.
Influence development of policy and regulations that affect financial sector through proactive engagement with regulator and participation in for a and events that deal with such matters.
Education
Bachelor Honours Degree: Law, Military Science and Security (Required)
